Terms of Service

These Terms of Service ("Terms") govern your access to and use of huddyseyewear.com (the "Site") and any products, services, or content provided by Huddys, LLC ("HUDDYS," "we," or "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By placing an order, you represent that you meet this requirement and that the information you provide is accurate.

Products

HUDDYS sells non-prescription, non-polarized fashion eyewear with UV400 protection. Our sunglasses are designed for use as everyday eyewear and are designed to be compatible with HUD-equipped vehicles. They are not medical devices, are not certified for use as personal protective equipment, and should not be used for activities requiring impact-rated safety eyewear.

We make every reasonable effort to display product colors and details accurately, but actual colors and finishes may vary slightly from on-screen images due to monitor calibration and photography conditions.

Orders, pricing, and payment

All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or stock issues. If we cancel your order after payment, we will issue a full refund.

Prices are listed in U.S. dollars and do not include applicable taxes or shipping. Sales tax is calculated at checkout based on the shipping address. Payment is processed at the time the order is placed, including for pre-orders.

Pre-orders

Some HUDDYS products are sold as pre-orders. The expected ship window is shown on the product page. We charge your card at the time of order. You may cancel a pre-order for a full refund any time before it ships. If a pre-order is delayed by more than 30 days from the original ship window, we will email you and offer a full refund or the option to wait.

Shipping, returns, and warranty

Our shipping and returns policies are set out in Shipping and Returns & Warranty. Those pages are incorporated into these Terms by reference.

Intellectual property

All content on the Site — text, images, logos, designs, product names, and the HUDDYS wordmark — is owned by Huddys, LLC or licensed to us, and is protected by U.S. and international copyright and trademark law. You may not copy, reproduce, or distribute any content from the Site without our written permission, except that you may share product images on social media in connection with your own purchase.

User-generated content

If you submit reviews, photos, comments, or other content to the Site or our social media accounts, you grant HUDDYS a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display that content in connection with our marketing and operations. You represent that you own the content or have permission to share it, and that it does not infringe anyone else's rights.

Disclaimers

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXCEPT FOR THE LIMITED WARRANTY DESCRIBED ON OUR RETURNS & WARRANTY PAGE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

HUDDYS sunglasses are not medical devices, are not certified for use as personal protective equipment, and are not rated for impact, ballistic, or chemical protection. Do not use HUDDYS sunglasses for any purpose for which impact-rated or medical-grade eyewear is required. Always operate vehicles and other equipment safely and in accordance with applicable law.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUDDYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY HUDDYS PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE RELEVANT PRODUCT.

Indemnification

You agree to indemnify and hold harmless Huddys, LLC and its officers, employees, and agents from any claim, demand, or damages arising out of your breach of these Terms or your misuse of the Site or any HUDDYS product.

Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be resolved in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.
